MARRIAGE:
Anna Maria Van Valkenburg and Philip J. Shell were married about 1824. He married second 21 dec 1849, Allen Co., Indiana, Bathsheba May (1803-1878), daughter of Ezra May and Bathsheba Armstrong, and widow of Hiram Bracy (d. 1839). Philip J. Shell was born about 1 Feb 1804 in New York, USA. He died on 5 Aug 1878 in Allen Co., Indiana, USA. He was buried in Shell-Sowers Cemetery, Scipio Twp., Allen Co., Indiana, USA.
WILL:
I, Philip J. Shell of the County of Allen and State of Indiana, declare, in this my last will and testament for the following manner of the disposition of my property to wit: First I bequeath and demise to my beloved wife Bethsheba all my real and personal property for her to have and to hold the same during her natural life as her own, to dispose of the same as she may deem necessary for her individual welfare.
Second: I request tha my wife's son Walstine shall have his home with my wife during their natural life, to be provided in case of sickness, by his natural mother, to promote his welfare free of any charges by any of my other heirs hereafter mntioned. And I further demise that my wife's son Walstine, if provided, he lives, to succeed the lives of myself and my wife then he is to have the avails ten (10) acres of land of the north east corner of part of my farm situate in section five (5) township thirty two (32) during his natural life, to have said proceeds as his own. I further demise and direct that my oldest daughter Hannah is and shall have Three Hundred Dollars ($300.00) out of my estate -- her or her heirs. My second oldest daughter Margaret, or her heirs, is to have Three Hundred Dollars ($300.00) out of my estate. My third oldest daughter Edith I direct to have one hundred dallars -- and each of her two children viz: William and Frances -- I give to them One Hundred Dollars each, out of my estate, to have as their own. To my son Francis I give and bequeath one pair of boots and one hat, equivalent to the amount of ten dollars to have as his own.
To my son Jacob I give and bequeath the sum of Five Hundred dollars ($500.00) to have and to hold himself or his heirs as their own. To my son Alfred I give and bequeath the sum of Fifty Dollars as his own.
To my son Francis' three children viz: Clarence, Harriet and Minard, I bequeath to each the sum of one hundred Dollars to have as their own.
To my son George's daughter Cora Dell, I demise and bequeath the sum of Three Hundred Dollars to have and to hold same as her own. I further request and demise that after the disposition of my property and effects herein before mentioned and eumerated, the balance to [be] equally divided amongst my remaining heirs, that will be living at the final disposition of my property after all my expenses are defrayed -- excepting my son Francis -- he is not to have anything more than herein mmentioned. It is expressly requested by me that only my own children living at the [time] of the final disposition of my property, are to become as heirs, except Francis as before stated. I further request that no timber that is now growiing oon my farm that I now occupy is to be cut down or otherwise destroyed during the life of my widow or at no time, unless actually necessary for the repair of the farm, but none shall be cut down and sold during her lifetime. I further request that my son Jacob and Alfred Shell be and are hereby appointed as my administrators to have full power according to law to settle up all my effects as I have hereinbefore mentioned after my demise, and my wife's. I further request that Michael Lindndemuth shall be duly and according to law have this my last will and testament handed in to the proper court ofr probate.
